Voting Terms & Conditions
These are the updated terms and conditions for Local Food Hero 2007, as of 25 July, which cover the voting terms and conditions. Please also see the general terms and conditions which relate to the Local Food Heroes submission of nominations and other material.
- 1. This vote (the "Vote") is promoted by UKTV INTERACTIVE LIMITED whose principal place of business is at 160 Great Portland Street, London W1W 5QA (the "Promoter") and who operates the UKTV Food website "www.uktvfood.co.uk" (the "Website").
- 2. You may cast your vote via the Website by registering and following the instructions to vote. NO PURCHASE OF ANY SORT IS NECESSARY and there is no charge to enter the Website. There are no alternative voting methods.
- 3. You may vote for as many Local Food Heroes as you like but you may only vote once for each Local Food Hero.
- 4. Vote Period. The Vote will open and be promoted on the Website from Tuesday 3rd April 2007 until the vote closes on Monday 20th August 2007 ("the Vote Period"). The Vote Period will consist of the First Round Voting (as defined below) and Second Round Voting (as defined below). Any votes and/or nominations received outside of the Vote Period (for whatever reason) will be invalid.
- 5. The Vote Procedure:
- First Round Voting: The first round of voting and nominations will commence when the Vote Period opens and will continue until it closes on Friday 29th June 2007 (“the First Round Voting”). The five strongest contenders from each region will be selected from a combination of votes and a judging panel. ("the Regional Finalist(s)"). There will be fifty (50) initial Regional Finalists comprising five (5) Regional Finalists per region from ten (10) regions in total (“the Region(s)”) which go through to the ten (10) regional finals ("the Regional Final(s)").
- Second Round Voting: The second round of voting and nominations will commence on Friday 29th June 2007 and will continue until the Vote Period closes (“the Second Round Voting”). The initial fifty Regional Finalists will be removed from the nominees for the Second Round Voting process. A sixth Regional Finalist from each Region will then be selected purely from the public vote by counting the highest number of votes taken from (i) votes for all nominees remaining in the Second Round Voting and (ii) votes for any additional nominees nominated during the remaining Vote Period (“"the Wild Card Vote)”). The winner with the highest number of votes from the Wild Card Vote for each Region will become the sixth Regional Finalist and will go straight to the relevant Regional Final without further input from the judges.
- For the avoidance of doubt, on completion of the Second Round Voting and following the closing of the Vote Period, the ten (10) Wild Card Vote winners will be added to the initial fifty (50) Regional Finalist(s) so that there will be sixty (60) Regional Finalist(s) comprising six (6) Regional Finalists for each Region that go through to the ten (10) Regional Final(s).
- 6. The Regional Final and the Grand Final Procedures:
The Regional Final:
Gary Rhodes will team up with a regional food advocate for each Region to examine and judge, against the criteria.
[each of the six Regional Finalist(s) for each Region and food on offer from that Region from which a winner for each Region will be selected ("the Regional Winners").
- The Grand Final: Each of the ten Regional Winners will proceed to the grand final (“the Grand Final”) in which Gary Rhodes will determine the winner of Local Hero 2007 (“the Winner”) who will be awarded the title of “UKTV Local Hero 2007” and the grand prize of £40,000 (“The Local Hero 2007 Award”).
- 7. Restrictions on Entry. The eligibility of any voter or Local Food Hero is at the sole discretion of the Promoter. Employees and their families or the agents of the Promoter or any of its associated companies are not eligible to enter the Vote. Any entry will be void if UKTV deems it incomplete, illegible or has been made by an ineligible person. Promoter reserves the right to discount votes if it has reasonable grounds to believe that votes have been cast in a fraudulent, misrepresentative or illegal manner (including bulk voting) .
- 8. Vote Administration and results of Regional Final and Grand Final . Nominees can make a one-off mid-point check in request of their personal vote tally for the Wild Card Vote via their business e-mail to uktvfood@uktv.co.uk from 23rd July 2007 until 5pm Monday 30th July 2007. The, details of the sixty Regional Finalists (including the winner of the Wildcard Vote in each region), the ten Regional Winners and the ultimate Winner of the Local Heroes 2007 Award will be broadcast on the UKTV Food channel in November 2007. The decision of the Promoter is final and no correspondence will be entered into. The results of the sixty Regional Finalists (including the six winners of the Wild Card Vote), the ten Regional Winners and the ultimate Winner of the award for Local Heroes 2007 can be requested by writing to UKTV referring to the name of this Vote at the Promoter's address set out above.
- 9. State of Votes The Promoter accepts no responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to votes, or votes lost, incomplete or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. All lost, damaged or incomplete votes will be deemed invalid. Proof of vote shall not be proof of delivery or receipt. Only votes received in accordance with these terms and conditions will be acceptable.
- 10. Terms and Conditions By entering the Vote, all voters are deemed to accept these terms and conditions. The Promoter may, at its sole discretion, change the dates of the Vote Period, or any other of these terms and conditions. Any changes to these terms and conditions will be posted on the relevant part of the Promoter's website and it is the responsibility of voters to check for any such changes. The Promoter may at any time suspend, withdraw or re-set voting at its sole discretion.
- 11. Data Protection and Privacy The Promoter or its associated companies will keep details of all entrants to the Vote on a database. By entering the Vote entrants allow the Promoter and its associated companies to use this information and to pass this information to other relevant third parties (such as prize fulfilment houses) to enable the processing of this Vote and, where the entrant has given the requisite consent, to send information about the Promoter's products and services and/or to share this information with other companies, in order that the entrant may be sent details of those companies' goods and services by email, post and SMS. Any personal data relating to voters will be used solely in accordance with current UK data protection legislation and voters acknowledge that they have read and agreed to the Promoter's Privacy Policy.
- 12. Rights in Vote. On submitting a vote, each voter irrevocably and exclusively grants and assigns to the Promoter with full title guarantee the entire copyright and all other rights of whatever nature in his/her entry for the full duration of such rights throughout the world.
- 13. Exclusion of Liability. Other than for death or personal injury arising from negligence of the Promoter, and to the maximum extent permitted by law, the Promoter hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused to or suffered by any person in connection with the Vote.
- 14. Governing Law. These terms and conditions are governed by and construed and performed in accordance with the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.
