1. This vote (the "Vote") is promoted by UKTV INTERACTIVE LIMITED (the "Promoter", “we” or “us”) or “UKTV” whose principal place of business is at 160 Great Portland Street, London W1W 5QA and who operates the Good Food website "www.goodfoodchannel.co.uk" (the "Website").

2. SPECIFIC RESTRICTIONS:
• All participants must be over 18 years of age at the date of entry and resident in the UK.
• All participants using web means of entry must have the bill payer’s permission prior to entering.
• Votes must be received within the Vote Period as set out below. Any votes received before or after this period will not be entered. Votes delayed by postal strike or for any other reason which are not received within the Vote Period will not be valid.
• Employees (including family members) of UKTV Interactive Limited, (or its group Companies) Optomen Television Limited, the producers of market Kitchen –(the “Producer”) we're afraid you are excluded from entering and your vote will not be considered.
• The eligibility of any voter or nominee is at the sole discretion of the Promoter.
• Drinks providers will not be included in the nominations for Local Food Heroes if a drink product is the sole item produced and/or sold by the nominee, please see the Nomination & Competition Terms and Conditions for more information on the LOCAL FOOD HEROES CRITERIA.
• Cookery schools and food markets will not be included in the nominations for Local Food Heroes.
• In the event of any dispute regarding these terms and conditions, conduct, results or any fault, misunderstanding, mistake or dispute concerning the operation of a vote, including the acceptability of any vote, or the operation of any technical/communications system, the Promoter’s decision shall be final.
• We reserve the right to discount votes if we have reasonable grounds to suspect fraudulent voting has occurred. We may suspend, withdraw or re-set voting in our sole discretion at any time.
3. VOTE PERIOD:
The Vote will be open on 22 June 2009, 12 noon and continue until 23.00hrs on 7 August 2009 (the “Vote Period”). Any votes received outside of the Vote Period (for whatever reason) will be invalid.
4. METHOD OF VOTING AND ENTRY COSTS
You may cast your vote(s) free of charge via the Website. You may need to register yourself, free of charge, on the Website if you are not already registered. There are no alternative voting methods.
You may vote for as many Local Food Heroes nominees (“Nominee(s)”) as you like but only one vote for each Nominee is allowed per registered user.
5. STATE OF VOTES.
The Promoter, its group companies and sub-contractors do not accept any responsibility or liability whatsoever for any technical failure or malfunction or any other problem in any telephone network or line, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded. Proof of vote shall not be proof of delivery or receipt. Only votes received in accordance with these terms and conditions will be acceptable.
6. HOW DO I PAY TO ENTER A VOTE?
Voting is free via the web. This is the only means of entry.
7. WHAT IF MY ENTRY IS LOST OR DAMAGED?
If we do not receive an entry from you for any vote then we cannot enter your vote, regardless of whether you sent the entry to us. Also, if we receive an entry from you that is illegible or incomplete or otherwise deficient we may not be able to enter your vote. We will not accept proof that an entry was sent as proof that we received it.
8. HOW WILL WE USE YOUR PERSONAL DETAILS?
• We will use your personal details to operate the vote that you are taking part in. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree to or refuse this.
• Your personal details will be treated in accordance with our Privacy Policy from time to time and in accordance with the law as it relates to people’s personal details.
9. HOW DO WE FIND OUT THE RESULTS OF THE VOTE? AND FURTHER INFORMATION REGARDING THE VOTE?
• The 10 (ten) Nominees with the highest number of votes in each of the 10 (ten) regions will, subject to certain verification checks including meeting the LOCAL FOOD HEROES CRITERIA and confirmation that the Nominee wishes to participate, to be one of the “Regional Nominees” will be published on the Website.
• There will be no further voting to determine the ultimate winner of Market Kitchen Local Food Hero Award 2009.
• The Regional Nominees will be reviewed by a panel of three industry experts (“the “Selection Panel”) who will short-list 3 (three) Regional Nominees per region (“the Regional Finalists”) based on expert judgement on how closely they meet the LOCAL FOOD HEROES CRITERIA. The Selection Panel will be made up of one member from the Producer and two other panellists completely independent of the Producer, the Promoter or any of their associates.
• Details of the 30 Regional Finalists will be published on the Website on or before 1 September 2009.
• Two Presenters (URL) from Market Kitchen will, between them, visit each of the Regional Finalists and will present a short feature on each Regional Finalist which may be broadcast on the programme, Market Kitchen in 2009 (the “Programme”).
• The decision of the Promoter is final and no correspondence will be entered into.
• A Judging Panel (the “Judging Panel”) of 5 industry experts will assess each of the Regional Finalists against the LOCAL FOOD HEROES CRITERIA. The Judging Panel will decide upon one of the Regional Finalists (the “Regional Winners”) per region, and also the overall winner of Market Kitchen Local Food Heroes 2009 (“The Winner”).
• The 10 (ten) Regional Winners will be invited to the Market Kitchen studio in November and may be filmed for broadcast on the Programme in 2009 (“THE GRAND FINAL”). The Judging Panel’s verdict on the Regional Winners and the overall winner (“the Winner”) will be announced within the Programme: one winner per region and one overall winner.
• The Winner will be awarded the title “Market Kitchen Local Food Hero 2009”, and will receive a trophy, and the grand prize of £5,000 (“Local Food Hero 2009 Award”).
• Participation in the recording of the programme known as Market Kitchen in London which we intend but do not undertake to produce and/or broadcast, will include an overnight stay at a hotel in London which Producer shall provide.
• Details of the Regional Finalists, the Regional Winners and the ultimate Winner of the Local Food Hero 2009 Award will be broadcast on the Programme on Good Food (and such other channels as Promoter shall decide) in November 2009 (although the Promoter reserves the right to change the date of broadcast). The decision of the Promoter is final and no correspondence will be entered into.
• The results of the Vote and details of all the Regional Nominees, the Regional Finalists, the Regional Winners and the ultimate Winner of the Local Food Hero 2009 Award can be requested by writing to UKTV referring to the name of this Vote at the Promoter's address set out above after broadcast of the Winner.
10. HOW FAR ARE WE LIABLE OR RESPONSIBLE TO YOU?
• Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the votes offered by us.
• We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.
11. When uploading images to the Local Food Hero Directory, registered web users must adhere to the terms and conditions linked with uploading images.
12. THE LEGAL POSITION OF THESE TERMS AND CONDITIONS
• By entering the Vote, all voters are deemed to accept these terms and conditions which form a legally binding agreement between you and us. We reserve the right to change them and update them from time to time but if we do so we will post the changes on this Website.
• These terms and conditions shall be governed by English law and are subject to the exclusive jurisdiction of the English courts.
