1. The promoter of the Market Kitchen Local Food Heroes ("Local Food Heroes") is UKTV INTERACTIVE LIMITED (the "Promoter", “we” or “us”) or “UKTV” whose principal place of business is at 160 Great Portland Street, London W1W 5QA and who operates the Good Food website "www.goodfoodchannel.co.uk" (the "Website").
2. Members of the public, owners and/or employees (each a "Contributor") may nominate a food outlet or service for the Competition run by the Promoter (the "Nominations"). The Nominations may be submitted via the Website. The Website is free to access and the Nominations are free to submit. Contributors are not entitled to any compensation, whether financial or otherwise, as a consequence of their submitting Nominations to Local Food Heroes.
3. By submitting information, any images or other material ("Material") to the Competition each Contributor agrees to be bound by these terms and conditions (the "Ts and Cs") by the UKTV General Competitions Terms and Conditions, the terms and conditions for uploading images and by the terms and conditions of the Website, which are available on the Website. In the event of any inconsistency these Ts and Cs shall prevail. IT IS IMPORTANT THAT THE CONTRIBUTOR OWNS THE COPYRIGHT SUBSISTING IN THE MATERIAL OR IS AUTHORISED BY THE OWNER OF THE COPYRIGHT TO SUBMIT THE MATERIAL.
4. All Nominations will undergo a verification process before appearing on the Website as Nominees for participation in the Competition. In some certain cases Nominations will not proceed to Nominee status, including but not limited to occasions where the owner of the food outlet or service, the subject of the Nomination does not wish to participate in the competition, or where such food outlet or service fails to meet the LOCAL FOOD HEROES CRITERIA.
5. Pubs selling alcohol but not food, food markets, cookery schools, individuals not running a business, and private clubs are ineligible to be considered for entering the Competition.
NOMINEES
6. By verifying the location and submitting other details of the food outlet or service that you own or are an employee of (“Nominee(s)”) and confirming your wish to participate in the Local Food Heroes competition the Nominee agrees that:
i) the location and other details of the Nominee may be published on the Website;
ii) if available a link to the Nominees website may be placed alongside the detail;
iii) they are willing to be filmed for inclusion or otherwise participate in the Market Kitchen television series (“the Programme”). The Promoter makes no assertions as to whether or not any such Programme will be made nor is the Promoter under any obligation to feature any such Nominee;
iv) in the event the Nominee becomes a Regional Finalist the Nominee agrees not to make any statements regarding the Competition or the Programme to any representative of the media or the press without the Promoters prior written consent;
v) they have a valid UK Bank Account.
How the Competition will be run:
7. Stage 1: Nominations and Voting
a) The Promoter will open up the Competition on the Website for submission of Nominations and voting on 22 June 2009 from 12noon .
b) Businesses nominated for a Local Food Hero Award in previous years, will be invited to reactivate their previous nomination online for inclusion in the Competition if they so wish to participate.
c) New Nominations may be submitted via the on-line form. All Nominations thereafter will be dealt with in the same manner.
d) At 23.00 hrs pm on 7 August 2009 the Vote will close. The 10 (ten) Nominees with the highest number of votes in each of the 10 (ten) regions (“The Regional Nominees”) will, subject to certain verification checks including meeting the LOCAL FOOD HEROES CRITERIA, be put through to the next stage of the Competition.
There will be no further public voting to determine the Local Food Heroes.
8. Stage 2: Selection and Judging
a) A panel of three industry experts (“the Selection Panel”), will select 3 (three) Regional Nominees from each of the 10 (ten) regions (“Regional Finalists”) to go through to the next stage of the Competition. The Selection Panel’s decision will be based on expert judgement on how closely the Regional Nominees meet the LOCAL FOOD HEROES CRITERIA. The Panel will be made up of one member from the Producer and two other panellists, completely independent of the Producer, the Promoter or any of their associates. UKTV reserves the right to amend the members of the Selection Panel and the Judging Panel;
b) The Regional Finalists will be filmed by the Producer and the material filmed may be broadcast as part of the Programme in 2009. Regional Finalists will need to ensure availability for filming between 31 August and 30 October;
c) Further assessment of the Nominees will be made by a Judging Panel (“the Judging Panel”) which will consist of 5 experts using the LOCAL FOOD HEROES CRITERIA. Matt Tebbutt and Matthew Fort will attend the judging meeting but will not be one of the judges. The Judging Panel will decide upon one Regional Finalist per region to go through to the grand final (“The Regional Winners”) and also the overall winner of Market Kitchen Local Food Heroes 2009.
9. Stage 3: The Grand Final
The 10 (ten) Regional Winners will proceed to the grand final (“the Grand Final”) which may be broadcast on the Programme, in which the Judging Panel’s verdict on the Regional Winners and the overall winner (“the Winner”) will be announced. The Winner will be awarded the title of “Market Kitchen’s Local Food Hero 2009” and will receive a trophy and the grand prize of £5,000 (five thousand pounds sterling) (the “Market Kitchen Local Food Heroes 2009 Award”).
10. Details of the Regional Finalists will be published on the Website on or before 1 September 2009. Details of the Regional Winners and the Winner of Market Kitchen’s Local Food Hero 2009 Award may be broadcast on the Programme on the channel known as Good Food (and such other channels as Promoter shall decide) in November 2009 (although the Promoter reserves the right to change the date of broadcast), and will be published on the Website following transmission of the relevant Programme episode. The decision of the Promoter is final and no correspondence will be entered into.
The results of the Vote, and details of the Regional Nominees, the Regional Finalists the Regional Winners and the Winner of the Market Kitchen Local Food Heroes 2009 Award can be requested by writing to UKTV referring to the name of this Competition at the Promoter's address set out above after broadcast of the Grand Final.
11. Nominees will need to provide a telephone number, preferably a mobile telephone number and be available for a telephone interview hosted by the Promoter from 10-17 August 2009. Nominees may be required for a further phone consultation on 20-21 August 2009. Regional Finalists must indicate their participation in the Competition by 12 noon, 25 August.
12. Regional Finalists, Regional Winners will need to be available for filming purposes from specified dates between 31 August and 30 October 2009.
13. By submitting Material to the Competition each Contributor:
a) represents that he/she accepts these Ts and Cs and the terms and conditions for uploading images. For the avoidance of doubt, any person submitting Material to the Promoter must be over 18 years of age. The eligibility of any Contributor is at the sole discretion of the Promoter;
b) warrants that:
i) all the information submitted by him/her in the process is true and accurate;
ii) the Material (images and any other media) represents the Contributor's own original work and that he/she is authorised to submit any and all Material submitted to the Promoter for the stated purposes by him/her and to grant, assign and/or waive the rights conferred by these Ts and Cs; and
iiii) no third party rights are infringed by his/her submission of Material to the Promoter and that no third party rights will be infringed by the use of any such Material by the Promoter.
c) irrevocably grants UKTV INTERACTIVE LTD and its associated companies a perpetual, royalty-free, non-exclusive, sublicenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play and exercise all copyright and publicity rights with respect to any such work and/or to incorporate it in other works in any media now known or later developed for the full term of any rights that may exist in such content, consistent with privacy restrictions set forth in UKTV INTERACTIVE LTD's Privacy Policy. If you do not wish to grant such rights to UKTV INTERACTIVE LTD, you should not submit your contribution to this Website. Each Contributor also irrevocably waives any and all so called 'moral rights' they may have in the Material.
d) agrees to indemnify the Promoter against any legal fees, damages and/or other expenses incurred as a direct or indirect consequence of any harm, damage, and/or loss or otherwise suffered by any third party as a result of any Material submitted by that Contributor.
14. The Promoter reserves full editorial control of the Programme. The Promoter reserves the right to remove and/or moderate any and all material in the Programme and/or published on the Website, but the Promoter has no obligation so to do.
15. The Promoter will remove any Material that it deems in its sole discretion to be unsuitable. Material will be unsuitable if it is (by way of example only and not by way of limitation) offensive, abusive, defamatory or unintelligible.
16. All rights (including without limitation, copyright and database rights) in or relating to Local Food Heroes title, the Programme and the Website are owned or controlled by or licensed to the Promoter, or otherwise used by the Promoter as permitted by applicable law.
17. The Promoter may wish to use the Material in the future for other purposes such as (by way of example only and not by way of limitation) in the production and broadcast of television programmes and/or the publication of a book containing selected Material. The Promoter reserves the right to require any and each Contributor (and Contributors agree to comply with any such request by the Promoter) to carry out any steps and to complete any and all documents necessary to permit the use of the Material for any such purpose(s).
18. The Promoter does not guarantee the quality or accuracy of any Nominations, reviews or other Material submitted by Contributors. The Promoter does not guarantee that any photographs and/or any other Material submitted by Contributors to accompany recommendations accurately represents the Nominees.
19. Any views, opinions or instructions contained within submitted Material do not represent the views or opinions of the Promoter. The Promoter does not endorse anything submitted by a Contributor that is contained within the Material in Programme and/or on the Website.
20. Data Protection and Privacy:
The Promoter will keep details of all Nominees to the Competition on a database. By verifying participation into the Competition Nominees agree that the Promoter and its associated companies may use this information in the context of the Local Food Heroes on-line, publicly accessible, database, and pass this information on to other relevant third parties only to the extent necessary to operate all aspects of the Competition and Programme. In all other respects personal data will be held for use in accordance with UKTV INTERACTIVE LTD's Privacy Policy.
21. The Promoter reserves the right to alter any aspect of the Competition and/or the Website and how it is run and/or managed.
22. These terms and conditions are governed by and construed and performed in accordance with the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.
